Welcome to PawGallery. These Terms of Service ("Terms") govern your use of our website located at pawgallery.store and the purchase of our custom pet portrait services. By accessing our site or purchasing our products, you agree to be bound by these Terms.
1. Acceptance of Terms
By using the PawGallery website, you represent that you are at least the age of majority in your state or province of residence. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services.
2. Products and Services
PawGallery provides custom digital pet portraits based on photos provided by the customer. We strive to be as accurate as possible in the rendering of your pet, but please understand that art is subjective and the final result is an artistic interpretation. Colors may vary slightly between what you see on your screen and the final printed product due to monitor settings and printing processes.
3. Ordering Process and Accuracy
When you place an order, you agree to provide current, complete, and accurate purchase and account information. You are responsible for ensuring that the photo you upload meets our quality guidelines. We reserve the right to refuse any order or request a new photo if the provided one is of insufficient quality to create a professional portrait.
4. Pricing and Payment
Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. All payments are processed securely through our third-party payment providers.
5. Intellectual Property Rights
Customer Ownership: You retain ownership of the original photo you upload. Upon final payment and delivery, you own the personal usage rights to the custom portrait created for you. You may print it for personal use, share it on social media, and display it in your home.
PawGallery Rights: We reserve the right to use the created artwork for our portfolio, marketing materials, and social media showcase. However, we will always respect your privacy and will seek explicit permission if you indicate you wish to keep the art private.
6. Photo Guidelines and Copyright
By uploading a photo, you represent and warrant that you own the rights to that photo or have permission from the owner to use it for this purpose. You agree not to upload any material that is infringing, defamatory, or otherwise unlawful.
7. Cancellation Policy
You may cancel your order for a full refund as long as our artists have not yet started work on your portrait. Typically, work begins within 12-24 hours of the order being placed. Once the artistic process has begun, we can only offer partial refunds to cover the artist's time.
8. Limitation of Liability
PawGallery shall not be liable for any direct, indirect, incidental, punitive, or consequential damages of any kind related to your use of our service or products. Our total liability to you for any claim arising out of these Terms shall not exceed the amount paid by you for the product in question.
9. Governing Law
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the United States.
10. Changes to Terms
We reserve the right to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes.
